1. Purpose
The Oasis Training Center website and application (hereinafter collectively referred to as the “Platform”) are the two access points to a training platform whose primary market is Africa.
These general terms and conditions define the terms and conditions of use of the services offered on the Platform (hereinafter referred to as the “Services”) and define the rights and obligations of the parties in this context.
They are accessible at any time via a direct link at the bottom of the website.
They may be supplemented, where applicable, by specific terms of use for certain Services, which supplement these general terms and conditions and, in the event of any conflict, take precedence over them.
2. Platform and Services Operator, Contact
The Platform and Services are operated by Oasis Research Institute (“Oasis”), a company registered in South Africa under number 2026/316691/07, with its registered office at Central Office Park Unit 4, 257 Jean Avenue, Centurion, Gauteng 0157, South Africa (hereinafter: “Oasis”).

3. Access to the Platform and Services
3.1 Legal Capacity
The Platform and Services are accessible to:
- Any natural person with full legal capacity to enter into these terms and conditions. A natural person who lacks full legal capacity may only access the Platform and Services with the consent of their legal representative.
- Any legal entity acting through a natural person with the legal capacity to contract in the name and on behalf of the legal entity.
4. Acceptance of the General Terms and Conditions
Acceptance of these General Terms and Conditions is indicated by checking a box on the registration form. This acceptance must be complete and unconditional. Any conditional acceptance will be considered null and void. Users who do not agree to be bound by these General Terms and Conditions must not access the Platform or use the Services.
5. Registration on the Platform
5.1 Use of the Services requires Users to register on the Platform by completing the designated form. Users must provide all information marked as mandatory. Incomplete registrations will not be validated.
Registration automatically creates an account in the User's name (hereinafter: the "Account"), granting access to a personal space (hereinafter: the "Personal Space") which allows the User to manage their use of the Services in a format and using the technical means that Oasis deems most appropriate for providing said Services.
The User guarantees that all information provided in the registration form is accurate, up-to-date, and truthful, and is not misleading in any way. The User is responsible for updating their information via their Personal Space.
The User agrees to update this information in their Personal Space in the event of any changes, so that it always meets the aforementioned criteria.
The User is informed and agrees that the information entered for the purpose of creating or updating their Account constitutes proof of their identity. The information entered by the User is binding upon validation.
The User is notified of the validation of their registration via a confirmation email sent by Oasis to the email address or WhatsApp number they provided during registration. Oasis reserves the right to request additional information from the User should they wish to access additional features.
5.2 The User can access their Personal Account at any time after logging in with their username and password.
The User agrees to use the Services personally and not to allow any third party to use them on their behalf or for their account, unless they assume full responsibility for such use.
They are also responsible for maintaining the confidentiality of their username and password, as any access to the Platform using these credentials will be deemed to have been made by the User. The user must immediately contact Oasis using the contact information provided in Article 2 herein if they notice that their Account has been used without their knowledge. They acknowledge Oasis's right to take all appropriate measures in such cases.
. Description of Services
The User has access to the following Services, in a format and according to the functionalities and technical means that Oasis deems most appropriate.
6.1 Training Catalog
The User has access to the different types of Training Services defined below:
- Free Training Content
Creating an account allows the User to access free training content, accessible via a catalog.
- Paid Training Content
Creating an account allows the User to access content in several ways:
- Either through a single training purchase related to a specific profession, which the User can access as many times as they wish, for one year from the date of purchase. Access to the training is non-transferable and individual.
- Either through the purchase of a training package related to a specific profession, which the User can access as many times as they wish for one year from the date of purchase. Access to the training package is non-transferable and individual.
- Or through a subscription allowing the User unlimited and unrestricted access to all training courses offered by Oasis on the Platform.
6.2 Information on the content offered by Oasis and the creative industries market
The User also has access to information on the training content and Services offered by Oasis via their "wall," which is their personal space.
On this wall, Oasis also provides the User with information (articles, reports, etc.) on the creative industries market.
6.3 Support and Assistance
Oasis offers Users a support and assistance service for any technical issues related to accessing the training courses, following subscription to the Services. This service can be accessed using the following email address: contact@oasis.africa
This support service is available from 10:00 AM to 5:00 PM on business days.
6.4 Other Services
Oasis reserves the right to offer any other Service it deems useful, in a format and according to the functionalities and technical means it considers most appropriate for providing said Services.
7. Financial Terms
7.1 Prices
The prices of the Services are indicated on the Platform. The User will only be able to access the Services once the total price of the Services has been paid by the User.
Unless otherwise stated, prices are expressed in Euros and include all French taxes.
Oasis reserves the right, at its sole discretion and according to terms it alone determines, to offer promotional offers or price reductions.
7.2 Price Revisions
The prices referred to in Article 7.1 may be revised by Oasis at any time, at its sole discretion.
The User will be informed of these changes by Oasis by any appropriate written means (including email and WhatsApp):
at least one month before the new prices take effect for individual courses and course packages purchased individually;
at least three months before the new prices take effect for the subscription price providing unlimited access to all courses offered by Oasis on the Platform.
These prices apply as soon as they take effect.
7.3 Billing
Invoices for the Services will be sent to the User by any appropriate means.
7.4 Payment Terms
The price of the Services is due upon ordering.
Payment can be made online by credit card, through the secure online payment service PayPal, or by any other means offered on the Platform at the time of ordering.
The User warrants to Oasis that they have the necessary authorization to use the chosen payment method.
7.5 Set-Off
The User expressly agrees that all payment obligations arising between the User and Oasis, where due date and amount are not in dispute, will be automatically set off against each other without any formality, whether or not the conditions for legal set-off are met. However, this set-off will not relieve either party of their accounting obligations, particularly those related to issuing invoices.
7.6 Payment Delays and Incidents
The User is hereby informed and expressly agrees that any delay in payment of all or part of any sum due on its due date will automatically result, without prejudice to the provisions of the articles relating to penalties for breaches and the termination of the Services, and upon the first presentation of a formal notice by registered letter with acknowledgment of receipt:
(i) the acceleration of all sums owed by the User and their immediate enforceability;
(ii) the immediate suspension of the Services in progress until full payment of all sums owed by the User;
(iii) the invoicing by Oasis of late payment interest at a rate of 1.5 times (one and a half times) the legal interest rate, calculated on the total amount of all sums owed by the User.
8. Express Waiver of the Right of Withdrawal
Users are informed that a right of withdrawal generally applies to distance service contracts between a professional and a consumer. This right must be exercised within 14 (fourteen) days of the contract's conclusion.
However, they are expressly informed and accept that the Services are provided to them upon registration and are thus fully performed before the end of the aforementioned withdrawal period. Consequently, they expressly waive their right of withdrawal, which therefore cannot be exercised, in accordance with Article L.221-28 of the French Consumer Code.
9. Evidence Agreement
The User expressly acknowledges and agrees:
(i) that the data collected on the Platform and Oasis's IT equipment shall be considered proof of the transactions carried out under this Agreement,
(ii) that this data constitutes the primary form of evidence admissible between the parties, particularly for calculating the amounts owed to Oasis.
The User can access this data in their Personal Account.
10. User Obligations
Without prejudice to the other obligations set forth herein, the User agrees to comply with the following obligations.
10.1 The User agrees, in their use of the Services, to comply with all applicable laws and regulations and not to infringe upon the rights of third parties or public order.
10.2 The User acknowledges having reviewed the characteristics and constraints, including technical constraints, of all the Services on the Platform. They are solely responsible for their use of the Services.
10.3 The User agrees to use the Services strictly for personal purposes. Consequently, the User is prohibited from assigning, granting, or transferring all or part of their rights or obligations under this Agreement to any third party, in any manner whatsoever.
10.4 The User agrees to provide Oasis with all information necessary for the proper performance of the Services. More generally, the User agrees to actively cooperate with Oasis for the proper performance of this Agreement.
10.5 The User expressly authorizes Oasis to use their Profile image for illustrative purposes on the Platform or for promotional purposes, by any means and on any medium, worldwide, for the duration of the User's registration on the Platform. This authorization is granted free of charge.
10.6 The User must take the necessary steps to back up, using their own means, any information from their Personal Account that they deem necessary, as no copy will be provided to them. 11. User Warranty
The User warrants Oasis against any and all claims, demands, actions, and/or proceedings that Oasis may incur as a result of the User's breach of any of its obligations or warranties under these terms and conditions.
The User agrees to indemnify Oasis against any and all damages it may suffer and to pay all costs, expenses, and/or judgments that Oasis may be required to bear as a result.
12. Prohibited Conduct
12.1 It is strictly forbidden to use the Services for the following purposes:
engaging in illegal or fraudulent activities, or activities that infringe upon the rights or safety of third parties;
disturbing public order or violating applicable laws and regulations;
intruding into a third party's computer system or any activity that could harm, control, interfere with, or intercept all or part of a third party's computer system, or violate its integrity or security;
sending unsolicited emails and/or commercial prospecting or solicitation;
manipulating a third-party website to improve its search engine ranking;
aiding or abetting, in any form or manner whatsoever, one or more of the acts and activities described above;
and more generally, any practice that misuses the Services for purposes other than those for which they were designed.
12.2 Users are strictly prohibited from copying and/or misappropriating for their own purposes or those of third parties the concept, technologies, all or part of the data, or any other element of the Oasis Platform.
12.3 The following are also strictly prohibited: (i) any behavior that may interrupt, suspend, slow down, or prevent the continuity of the Services, (ii) any intrusions or attempted intrusions into Oasis's systems, (iii) any misappropriation of the Platform's system resources, (iv) any actions that may impose a disproportionate load on the Platform's infrastructure, (v) any breaches of security and authentication measures, (vi) any acts that may infringe upon the financial, commercial, or moral rights and interests of Oasis or the users of its Platform, and finally, more generally, (vii) any breach of these terms and conditions.
12.4 It is strictly forbidden to monetize, sell, or grant access to all or part of the Services or the Platform, as well as to the information hosted and/or shared therein.
13. Penalties for Violations
In the event of a breach of any of the provisions of these terms and conditions, or more generally, any violation of applicable laws and regulations by a User, Oasis reserves the right to take any appropriate action, including:
(i) suspending the User's access to the Services, whether the User committed the breach or violation, or participated in it,
(ii) removing any content posted on the Platform,
(iii) publishing any informational message on the Platform that Oasis deems useful,
(iv) notifying any relevant authority,
(v) initiating any legal action.
14. Oasis's Liability and Warranty
14.1 Oasis undertakes to provide the Services diligently and in accordance with best practices, it being specified that it is bound by an obligation of means, to the exclusion of any obligation of result, which the Users expressly acknowledge and accept.
14.2 Oasis disclaims all liability in the event of any loss of information accessible in the User's Personal Space, the User being responsible for saving a copy and not entitled to any compensation in this regard.
14.3 Oasis undertakes to conduct regular checks to verify the operation and accessibility of the Platform. Accordingly, Oasis reserves the right to temporarily interrupt access to the Platform for maintenance purposes. Oasis shall not be held liable for any temporary difficulties or inability to access the Platform due to circumstances beyond its control, force majeure, or disruptions to telecommunications networks.
14.4 Oasis does not guarantee to Users (i) that the Services, which are subject to ongoing research to improve their performance and functionality, will be completely free from errors, defects, or flaws, (ii) that the Services, being standard and not tailored to any specific User based on their individual constraints, will specifically meet their needs and expectations.
14.5 In any event, Oasis's liability under this agreement is expressly limited to proven direct damages suffered by the User.
15. Intellectual Property
The systems, software, structures, infrastructure, databases, and content of any kind (text, images, visuals, music, logos, trademarks, databases, etc.) used by Oasis within the Platform are protected by all applicable intellectual property rights and database producer rights. Any disassembly, decompilation, decryption, extraction, reuse, copying, and more generally, any act of reproduction, representation, distribution, or use of any of these elements, in whole or in part, without Oasis's authorization is strictly prohibited and may be subject to legal action.
16. Personal Data
Oasis has a personal data protection policy, the details of which are explained in the document entitled "Charter on the Protection of Personal Data," which the User is expressly invited to read.
17. Confidentiality
Each party undertakes to keep strictly confidential all documents, materials, data, and information of the other party that it receives and that are expressly identified by the other party as confidential. With respect to Oasis, the parties expressly agree that this confidentiality obligation covers the personal data that Oasis will process for the User in connection with the Services. All such information is hereinafter referred to as "Confidential Information."
The party receiving Confidential Information undertakes not to disclose it without the prior consent of the other party for a period of five (5) years from the completion of the relevant Services. It may only transmit it to employees, collaborators, interns, or advisors if they are bound by the same confidentiality obligation as that provided herein. This obligation does not extend to documents, materials, data, and information:
(i) of which the receiving party already had knowledge;
(ii) already public at the time of their disclosure or which become public without a breach of these terms and conditions;
(iii) which were lawfully received from a third party;
(iv) the disclosure of which is required by judicial authorities, pursuant to laws and regulations, or to establish a party's rights under these terms and conditions.
18. Advertising
Oasis reserves the right to insert advertising or promotional messages on any page of the Platform and in any communication to Users, in a form and under conditions determined solely by Oasis.
19. Duration of Services, Cancellation
The Services are provided on a subscription basis (hereinafter: the "Subscription").
The Subscription begins on the date of subscription, subject to payment of the price in accordance with Article 7.1, for a period of one year from the date of payment. The Subscription may only be renewed upon the User's express request to that effect, and subject to payment of the Subscription fee by the User on the Platform.
The User may cancel the Subscription through their Personal Account but will not be eligible for any refund.
Oasis may cancel the Subscription by sending an email to the User.
Any Subscription Period that has commenced is due in full.
20. Modifications
Oasis reserves the right to modify these terms and conditions at any time.
The User will be informed of these modifications by any appropriate means.
Users who do not accept the modified terms and conditions must unsubscribe from the Services in accordance with the procedures set forth in Article 19.
Any User who uses the Services after the modified terms and conditions come into effect is deemed to have accepted these modifications.
21. Language
In the event of a translation of these terms and conditions into one or more languages, the French version shall prevail in the event of any discrepancy or dispute regarding the meaning of a term or provision.
22. Mediation
The User has the right to use a consumer mediator free of charge to resolve amicably any dispute concerning the performance of these terms and conditions that may arise between the User and Oasis, under the conditions set forth in the South African Consumer Code.

23. Governing Law and Jurisdiction
These terms and conditions are governed by South African law.
In the event of any dispute concerning the validity, interpretation, and/or performance of these terms and conditions, the parties agree that the courts of Johannesburg shall have exclusive jurisdiction, unless otherwise required by mandatory procedural rules.
